Welcome to Day 41 Thrive Consulting LLC. By purchasing, accessing, or using any product, program, service, or coaching session provided by Day 41 Thrive Consulting LLC, you agree to the following Terms and Conditions. These terms apply to all offerings, whether delivered digitally, in person, or virtually.
1. Privacy Policy
We are committed to protecting your privacy. By using our services, you agree to the collection and use of information in accordance with this policy.
What We Collect:
- Name, email, and business contact info
- Payment information (processed via third-party systems like Stripe)
- Usage data related to websites, forms, and tools
How We Use It:
- Deliver services and manage client accounts
- Improve product performance and client experience
- Send updates, resources, and occasional marketing (with opt-out options)
We do not sell, trade, or rent your data to third parties.
2. Scheduling and Missed Appointments for Coaching Calls
Scheduled coaching calls or strategy sessions must be rescheduled at least 24 hours in advance using the provided scheduling system (e.g., Calendly) or by contacting our team.
- Calls not rescheduled before the 24-hour mark are considered locked in.
- No refunds or reschedules will be granted for missed calls or late cancellations within the 24-hour window.
- Exceptions may be made in the event of documented emergencies, solely at Day 41 Thrive Consulting LLC's discretion.
3. Product Access and Usage Rights
All intellectual property and content shared by Day 41 Thrive Consulting LLC is protected by copyright and remains the property of Day 41 Thrive Consulting LLC. Purchases grant you a non-transferable, non-exclusive license to use the materials internally within your business.
You may not:
- Share, resell, or redistribute any material
- Rebrand Day 41 Thrive Consulting LLC content as your own
- Grant access to third parties without written permission
4. No Refund Policy
All sales are final. Due to the nature of our products and services—which include access to digital content, proprietary frameworks, coaching time, and downloadable templates—Day 41 Thrive Consulting LLC maintains a strict no-refund policy. This includes but is not limited to:
- Digital downloads and SOP manuals
- Strategy sessions, coaching packages, or consulting retainers
- Subscription or membership-based access
- Live or recorded training sessions
Please reach out prior to purchase with any questions. We're happy to clarify what's included to ensure the product is right for you.
5. Intellectual Property
All materials, including but not limited to frameworks, names, manuals, templates, and coaching methodologies, are the sole intellectual property of Day 41 Thrive Consulting LLC. Unauthorized use or duplication is strictly prohibited.
6. Limitation of Liability
Day 41 Thrive Consulting LLC provides tools, coaching, and strategies designed to support your business growth. However, results are not guaranteed, and success depends on implementation. You agree that:
- Day 41 Thrive Consulting LLC shall not be liable for direct or indirect losses related to your use of any of our content or services.
- We are not financial, legal, or tax advisors. Please consult professionals where appropriate.
7. Indemnification
Client agrees to indemnify, defend, and hold harmless Day 41 Thrive Consulting LLC, including its officers, directors, agents, contractors, and employees, from any and all claims, damages, liabilities, losses, and expenses (including reasonable attorney's fees) arising from (i) any breach of these Terms by the client, or (ii) any act or omission by the client related to the use or misuse of Day 41 Thrive Consulting LLC's services or materials, except where such claims arise from the gross negligence or willful misconduct of Day 41 Thrive Consulting LLC.
8. Non-Solicitation of Employees
During the term of engagement and for a period of twelve (12) months thereafter, clients agree not to directly or indirectly solicit, hire, or engage any employee, coach, or subcontractor of Day 41 Thrive Consulting LLC without prior written consent. Any breach of this provision will result in liquidated damages equal to twelve (12) months of the employee's or contractor's most recent compensation paid by Day 41 Thrive Consulting LLC.
9. Subscription Terms
Certain offerings operate on a recurring monthly or annual billing basis.
- You may cancel future billing at any time through your account portal.
- Canceling mid-cycle does not qualify for a refund or proration.
- Access to gated content will end when your billing cycle concludes.
Flagship Coaching Program Policy:
The Flagship Coaching program includes a 12-month commitment. We invest significant time and resources upfront to ensure a transformational experience—this includes assigning dedicated coaches and planning delivery schedules months in advance. If a client wishes to exit early, they may do so with a minimum payment equal to six months of service. Early exit must be requested in writing and approved by the Day 41 Thrive Consulting LLC team.
10. Results May Vary
The success of any Day 41 Thrive Consulting LLC product, service, or coaching engagement is influenced by multiple factors outside of our control. While our frameworks, systems, and materials are designed to drive measurable business growth, results will vary depending on each client's ability to implement and maintain the tools provided fully.
Key factors impacting outcomes include, but are not limited to: the level of leadership engagement and buy-in, the consistency and timeliness of implementation, internal team participation, organizational structure, market conditions, staffing capabilities, and existing process maturity. We do not guarantee specific financial outcomes, operational results, or performance benchmarks.
The value of each product or program depends heavily on a client's commitment to training, follow-through, and strategic alignment. Clients should treat all resources provided as tools—successful outcomes require the client's internal team to use, be accountable for, and continuously improve the systems shared. Clients who fail to implement, adapt, or sustain the systems shared assume full responsibility for any limited or unfavorable results.
By purchasing or engaging with Day 41 Thrive Consulting LLC, you acknowledge and accept this variability.
Hold Harmless:
By using our services or purchasing our products, you agree to hold Day 41 Thrive Consulting LLC and its team harmless from any claims, damages, or losses—direct or indirect—that may arise from your use or misuse of the materials, strategies, or advice provided. This includes, but is not limited to, lost revenue, missed opportunities, business interruptions, staffing issues, or failure to meet financial goals. Clients accept full responsibility for their own results, business decisions, and implementation outcomes.

Options include one-off calls, short-term plans, or full-scale executive growth partnerships. Includes SOP implementation, hiring support, and strategy.

CRM audits, data cleanup, automation flows, and team training. Includes optional migration services and "Data Evac Plan."

Branding services from light audits to full rebrands. Includes logos, print design, vehicle wraps, social media assets, and an optional magazine.
Personal Development Coaching
One-on-one coaching program focused on mindset, resilience, and internal growth for emerging and established leaders.

Phone script system and training platform for CSRs and sales support teams. Includes call guides, objection training, and follow-up flows.
Know Before You Grow – Business Audit
Onsite deep dive into marketing, sales, ops, admin, and culture. Includes pre-assessment, leadership interviews, and roadmap delivery.
Training Programs
Live or virtual team development in sales, leadership, or operations. Customized content delivery for real-world contractor teams.
12. Mutual Non-Disclosure Agreement (NDA)
Both parties—Day 41 Thrive Consulting LLC ("Consultant") and the Client—agree to maintain strict confidentiality regarding any proprietary information, strategies, documents, frameworks, methods, internal processes, trade secrets, or business insights shared during the course of engagement.
Neither party may disclose, distribute, reproduce, or share any confidential information—verbally, in writing, or through digital means—with any third party without prior written consent from the other party. This includes, but is not limited to, internal conversations, proprietary materials, training documents, coaching insights, and any non-public business practices or results.
Exceptions to this agreement may be made only with mutual written permission, including but not limited to use of names, logos, quotes, or performance data in case studies, testimonials, marketing materials, or public reviews.
This mutual confidentiality obligation survives the termination or completion of the engagement and remains in effect indefinitely unless otherwise agreed to in writing.
13. Payment Processing Fees
All payment processing fees are the sole responsibility of the client and will be added to the invoice total. These fees apply to all transactions, regardless of payment method, and are charged by our payment processor:
- One-Time Account Setup Fee: $20.00 (deducted from the first disbursement)
- Credit & Debit Card Transactions: 3.2% + $0.29 per transaction
- Credit/Debit Refund or Void/Reverse Authorization: $0.05 each occurrence
- ACH / eCheck Transactions: 1% per transaction, capped at $50.00 maximum
- eCheck Refund: $0.15 per occurrence
- eCheck Return (Bounced Check): $2.50 per occurrence
- Dispute-Related Fees:
- Retrieval: $15.00 per occurrence
- Chargeback: $15.00 per occurrence
- Arbitration: $10.00 per occurrence
14. Updates to These Terms
We may update these Terms and Conditions as needed. Changes will be posted to this page. Continued use of any Day 41 Thrive Consulting LLC products or services constitutes agreement with the updated terms.
